Professor John Sharkey AM

John Sharkey is a commercial arbitrator and mediator with particular experience in the construction, engineering, energy and related industries. John is: 

  • an honorary Professorial Fellow of the University of Melbourne; 
  • an elected Fellow of the Australian Academy of Law; and
  • a Member of the Order of Australia. 

John has sat as an arbitrator and mediator within Australia and internationally on over 80 occasions.  He is co-author of “Commercial Arbitration” (Law Book Company 1986) and “Building and Construction Contracts” (2nd ed. Law Book Company 1990). 


Professional Experience 

John is the former head of the Construction and Engineering division of Norton Rose Fulbright Australia and has practiced construction law for more than 40 years.   

John was an inaugural board member of the Society of Construction Law Australia. He was a founding fellow of the International Academy of Construction Lawyers.

Dispute Avoidance and Resolution Experience 
Recent appointments include: 

  • arbitrator of disputes concerning delayed delivery of a natural gas pipeline project; 
  • arbitrator in a dispute concerning the installation of a subsea tree in a Timor Sea oilfield:(Cameron Australasia Pty Ltd v AED Oil Ltd [2015] VSC 163);  
  • chair of the DRB for the New Zealand Inter-Island HVDC Pole 3 Project;   
  • arbitrator in a dispute in relation to delay and variation claims arising out of the construction of an aged care facility; 
  • mediator of disputes over the fit-out of an Asian resort and hotel; 
  • member of tribunal appointed to determine disputes arising from the construction of a combined cycle power plant; 
  • sole arbitrator of disputes arising in connection with the design and construction of a New South Wales wind farm.
